Note: the Alienation of Land Act requires wet-ink signatures for the actual sale of immovable property (offers to purchase and deeds of sale). Can a lease agreement be signed electronically in South Africa?
Yes. Residential and commercial lease agreements are valid when signed electronically under the ECT Act. The exception is a lease agreement exceeding 20 years, which requires wet-ink signatures under the Alienation of Land Act.
